Alberta’s Prompt Payment and Construction Lien Act
Prompt payment is one of the most important issues facing Alberta’s construction industry. Late or uncertain payment impacts every link in the construction chain, from owners and general contractors to trade contractors and suppliers.
Alberta’s Prompt Payment and Construction Lien Act sets out mandatory timelines for payment, lien rights, and a new adjudication process designed to resolve payment disputes quickly and keep projects moving. All new construction contracts in Alberta must comply with the Prompt Payment and Construction Lien Act, and contracts extending beyond August 29, 2024, are now required to be aligned with the legislation.
ACA works with government and industry partners to inform these rules and help members understand how they apply in practice.
Recent Changes And Ongoing Updates
Since coming into force in August 2022, the legislation has continued to evolve. In 2024, Bill 30 (Service Alberta Statutes Amendment Act) introduced further amendments to create greater certainty for project participants, with additional changes to the Prompt Payment and Construction Lien Act and the Public Works Act took effect April 1, 2025.
ACA follows these developments closely, engages with the government on necessary refinements, and updates our member resources to reflect the latest requirements.
